Why we no longer sell the Elfbar 2500

Because there was no specific legal basis – in other words, because e-cigarettes were not covered by Swiss tobacco product legislation – nicotine-containing e-liquids and pre-filled nicotine cartridges may be sold under the Cassis de Dijon principle. This states that, in the interest of competitiveness, products may also be sold in Switzerland if they are authorised in the European Economic Area. The EU Tobacco Products Directive stipulates that nicotine-containing e-liquids must not exceed a pack size of 10ml. Pre-filled cartridges and disposable vapes must also not contain more than 2ml of e-liquid. Although there is one country within the European Economic Area where this restriction does not apply, in November 2023 we were instructed to comply with EU standards, even though these products should also be saleable in Switzerland under the Cassis de Dijon principle. Clarifying this legal situation in court would likely take longer than the finalisation of the new Swiss Tobacco Products Ordinance, which will bring us this problem anyway. In practical terms, this means that since the November 2023 ruling we have no longer been allowed to import disposable vapes with more than 2 ml of liquid, although we were assured that products already imported could continue to be sold off until the end of August 2024.

Personally, we don’t see any sensible purpose behind this restriction, other than making e-cigarettes less attractive as a way to move away from tobacco use. In our view, it is both consumer-unfriendly and ecological nonsense. If disposable vapes are limited to a maximum of 600 puffs or a 2ml fill volume, the main result is simply more waste.

As an alternative to larger disposable vapes, new models are now available where the disposable vape itself has a 2ml fill volume and is supplied with an additional 10ml bottle of e-liquid, giving you a larger overall volume after all.
