1. Scope of these Terms and Conditions and conclusion of the contract
- 1.1 These Terms and Conditions (T&Cs) apply to purchase contracts with private customers and businesses concluded through the provider’s website.
- 1.2 The provider confirms the order. The contract is concluded as soon as the buyer receives the confirmation. If confirmation is not received within a reasonable time, the buyer may treat this as a rejection of the order and is entitled to conclude a contract with another supplier.
2. Prices and special offers
- 2.1 Prices are shown in CHF. VAT, the advance recycling fee and handling are included. Shipping costs are charged separately.
- 2.2 The provider reserves the right to change prices at any time. The prices published on the website on the order date apply to customers.
- 2.3 The terms for promotions and discounts are available in the relevant offer details.
- 2.4 The lowest-price guarantee applies only to comparable shops; it does not apply to auctions or offers that are limited by time or quantity, and it applies only if the product is also in stock at the shop in question. Because we offer free shipping, the product price must always be compared together with the cheapest available shipping method. We are also unable to offer products below the minimum retail price set by the manufacturer.
3. Shipping and delivery terms

- 3.2 Customers abroad are responsible for checking which products may be imported.
- 3.3 If, for an international shipment, customs returns the goods, the value of the goods (excluding shipping costs) will be refunded, less a CHF 10.- processing fee.
- 3.4 If the customer orders goods for delivery abroad and they are confiscated/destroyed by customs, the customer is not entitled to a refund of the purchase price.
- 3.5 We fully guarantee all domestic parcels until they are delivered. We are not liable for parcels that have been successfully delivered but later disappear from the doorstep.
- 3.6 If a delivery does not arrive due to possible theft, the customer must report this within 14 days so that a tracing procedure can be opened. Reporting a theft is the customer’s responsibility.
- 3.7 Shipping costs are displayed before the order is confirmed. The buyer accepts them when completing the order. If the actual shipping costs differ from the amount charged, this does not give rise to any right to a refund of any kind.
- 3.8 For returns / exchanges, the seller reserves the right to charge the buyer a processing fee of 10% of the value of the goods, or a flat fee of CHF 10.-, plus the shipping costs incurred.
- 3.9 The customer must be at least 18 years old.
4. Cancellation and withdrawal rights
- 4.1 For orders within Switzerland and Liechtenstein, customers may withdraw from the purchase contract within 7 days without giving a reason and without penalty, provided the product has not been used and the packaging has not been opened. The period for exercising this right begins on the day the goods arrive with the consumer. The customer may return goods that have already been delivered at their own expense. Payments already made will be refunded by the provider free of charge. Shipping costs must still be paid. If no shipping costs were charged for the delivery, the buyer will be invoiced for the actual shipping costs.
- 4.2 If a customer withdraws from the purchase due to delayed delivery or defects in the goods for which the provider is responsible, the provider will refund the amounts already paid as well as the return shipping costs.
- 4.3 For hygiene reasons, e-liquids and flavour concentrates are excluded from the right of return.
5. Data mining
- 5.1 It is expressly prohibited to use manual or automated software, devices or other processes such as spiders, robots, scrapers, crawlers, avatars, data-mining tools or similar to download or extract data from the websites by scraping or any other means.
Operators of public search engines are exempt from this.
6. Liability and warranty
- 6.1 Unless otherwise stated for the product, the terms at https://www.dampfi.ch/warranty apply.
- 6.2 The buyer must inspect the delivered goods as soon as possible and report any defects immediately. The relevant customer service team can be reached at https://www.dampfi.ch/kontakt/ . Hidden defects may also be reported after the goods have been put into use. Payment does not constitute a waiver of the right to report defects.
- 6.3 If there is a defect covered by the provider’s warranty terms, the buyer may choose to request a free repair, deduct an amount from the price corresponding to the reduced value, withdraw from the contract or obtain a replacement delivery. The buyer’s right to claim damages is reserved in all cases.
- 6.4 In the event of a warranty claim, the customer may send the devices by post or bring them to the shop. For an on-site diagnosis, the seller reserves the right to keep the device for several days for a more thorough inspection. If the customer sends it by post, the customer bears the postage costs.
- 6.5 For returns that do not comply with the warranty terms defined by the seller, the seller reserves the right to charge the customer processing & shipping fees of up to CHF 50.-.
- 6.6 The seller is not liable for damage caused by improper handling.
7. Payment
- 7.1 Customers may choose from the following payment methods:
- The invoice is enclosed when the goods are shipped. In this case, payment is due 14 days after receipt of the invoice.
- The customer may provide their credit or debit card number. All major credit cards are accepted via PayPal. The price of the goods is charged on the day the goods are shipped.
- 7.2 In the event of late payment, the provider will send no more than three payment reminders. A fee of CHF 5.- is charged for the second reminder and CHF 15.- for the third reminder. If the customer still does not pay, debt enforcement measures will be initiated. Default interest will also be charged on late payments. The right to claim damages is reserved. If the invoice is not paid after the third reminder, the seller reserves the right to refer the claim to a debt collection agency or directly to the debt enforcement office. Any costs incurred are borne by the debtor.
- 7.3 The seller reserves the right to carry out a credit check for the invoice payment method and is not obliged to offer this payment method.
8. Liability for online connections
- 8.1 The provider undertakes to ensure state-of-the-art security for systems, software, etc. that belong to it and over which it has control, and to comply with data protection rules.
- 8.2 Customers are responsible for the security of the systems, software and data within their area of control. In their own interest, customers should keep passwords and usernames confidential and not disclose them to third parties.
- 8.3 The provider is not liable for defects or disruptions for which it is not responsible, in particular security defects or operational failures at third-party companies with which it works or on which it depends.
- 8.4 Furthermore, the provider is not liable for force majeure, improper conduct and disregard of risks by the customer or third parties, excessive use, unsuitable equipment used by the customer or third parties, extreme environmental influences, interference by the customer, or disruptions caused by third parties (viruses, worms, etc.) that occur despite the necessary up-to-date security precautions.
9. Applicable law and place of jurisdiction
- 9.1 These T&Cs are governed by Swiss law.
- 9.2 For lawsuits brought by a customer, the court at the seller’s registered office has jurisdiction. For lawsuits brought by the provider, the court at the defendant’s domicile has jurisdiction.
