Why don’t we sell the Elfbar Lowit 2500 Pod Set anymore?

Due to the lack of a specific legal basis, or rather because e-cigarettes were not covered by Swiss tobacco product legislation, nicotine-containing e-liquids and prefilled cartridges with nicotine could be sold under the Cassis de Dijon principle. This principle states that, in the interest of competitiveness, products may also be sold in Switzerland if they are authorised in the European Economic Area. The EU Tobacco Products Directive stipulates that e-liquids containing nicotine must not be sold in packaging larger than 10 ml. Prefilled cartridges and disposable e-cigarettes must also not contain more than 2 ml of e-liquid. Although there is a country in the European Economic Area where this restriction does not apply, in November 2023 we were instructed to comply with EU standards, regardless of the fact that, under the Cassis de Dijon principle, these products should also be marketable in Switzerland. Clarifying this legal situation in court would likely take longer than the finalisation of the new Swiss Tobacco Products Ordinance, which will create this issue for us anyway. In concrete terms, this means that since the ruling in November 2023 we have not been allowed to import disposable e-cigarettes with more than 2 ml of e-liquid, although we were assured that we could sell off products already imported until the end of August 2024.

Personally, we don’t see any reasonable purpose behind this restriction, other than making e-cigarettes less attractive as a way to move away from tobacco. We therefore consider it consumer-unfriendly and environmentally nonsensical. If disposable e-cigarettes are only allowed to offer a maximum of 600 puffs, or a 2 ml fill volume, this simply creates more waste.

As an alternative to larger disposable e-cigarettes, there are now new models where the disposable vape itself has a 2 ml fill volume, but also includes an additional 10 ml bottle of e-liquid so you still get a larger total volume.
