Why don't we sell the Lost Mary BM3500 anymore?

Because there was no clear legal basis — in other words, e-cigarettes were not covered by Swiss tobacco product legislation — nicotine-containing e-liquids and prefilled nicotine cartridges could be sold under the Cassis de Dijon principle. This principle says that, for reasons of competitiveness, products may also be sold in Switzerland if they are approved in the European Economic Area. EU tobacco product regulations state that nicotine-containing e-liquids must not exceed a pack size of 10 ml. Prefilled cartridges and disposable e-cigarettes may also contain no more than 2 ml of e-liquid. Even though one country in the European Economic Area does not apply this restriction, in November 2023 we were instructed to comply with EU standards, regardless of the fact that these products should also be marketable in Switzerland under the Cassis de Dijon principle. Clarifying this legal situation in court would likely take longer than the finalisation of the new Swiss Tobacco Products Ordinance, which will impose this issue on us anyway. In practical terms, this means that since the order in November 2023, we have no longer been allowed to import disposable vapes with more than 2 ml of liquid; however, we were permitted to sell through products already imported until the end of August 2024.

Personally, we don't see any sensible reason for this restriction, apart from making e-cigarettes less attractive as a way to move away from tobacco use. We therefore consider it consumer-unfriendly and environmentally absurd. If disposable vapes are only allowed to offer a maximum of 600 puffs or a 2 ml fill volume, the result is simply more waste.

As an alternative to larger disposable vapes, there are now new models where the disposable vape has a 2 ml fill volume but also comes with a 10 ml bottle of e-liquid, ultimately giving you a larger total volume.
