Why do we no longer sell the Lost Mary MO5000?

Due to the lack of a clear legal basis—in other words, because e-cigarettes were not covered by the Swiss Tobacco Products Act—nicotine-containing e-liquids and prefilled cartridges with nicotine could be sold under the Cassis de Dijon principle. This principle states that, in the interests of competitiveness, products may also be sold in Switzerland if they are approved in the European Economic Area. The EU Tobacco Products Directive sets a maximum container size of 10 ml for nicotine-containing e-liquids. Prefilled cartridges and disposable e-cigarettes must also not contain more than 2 ml of e-liquid. Although there is one country in the European Economic Area where this restriction does not apply, in November 2023 we were instructed to comply with EU standards—despite the fact that, under the Cassis de Dijon principle, these products should also be eligible for sale in Switzerland. Challenging this legal position in court would most likely take longer than the finalisation of the new Swiss Tobacco Products Ordinance, which will bring about this problem in any case. For us, this specifically means that since the ruling in November 2023 we have no longer been allowed to import disposable e-cigarettes with more than 2 ml of liquid, although we were granted a sell-through period for products already imported until the end of August 2024.

Personally, we don't see any sensible reason for this restriction, other than making e-cigarettes less attractive as a way to move away from tobacco. We therefore consider it consumer-unfriendly and environmentally nonsensical. If disposable e-cigarettes are limited to a maximum of 600 puffs, or a 2 ml fill volume, the result is simply more waste.

As an alternative to the larger disposable e-cigarettes, new models are now available where the disposable e-cigarette has a 2 ml fill volume but comes with an additional 10 ml bottle of e-liquid, giving you a larger overall volume.
