Why don’t we sell the Vozol Gear 10000 anymore?

Due to the lack of a specific legal basis — or, more precisely, because e-cigarettes were not included in the Swiss Tobacco Products Act — nicotine-containing e-liquids and pre-filled cartridges with nicotine could be sold under the Cassis de Dijon principle. This principle states that, in the interests of competitiveness, products approved in the European Economic Area may also be sold in Switzerland. The EU Tobacco Products Directive stipulates that e-liquids containing nicotine must not exceed a pack size of 10 ml. Pre-filled cartridges and disposable e-cigarettes must also not contain more than 2 ml of e-liquid. Although there is a country in the European Economic Area where this restriction does not apply, in November 2023 we were instructed to comply with EU standards, even though these products should have been marketable in Switzerland under the Cassis de Dijon principle. Clarifying this legal situation in court would likely take longer than the finalisation of the new Swiss Tobacco Products Ordinance, which will create this issue for us anyway. In concrete terms, this means that since the order issued in November 2023, we have no longer been allowed to import disposable e-cigarettes with more than 2 ml of liquid, while we were assured that products already imported could be sold off until the end of August 2024.

We personally see no sensible reason for this restriction, other than making e-cigarettes less attractive as a way to move away from tobacco consumption. We therefore consider it consumer-unfriendly and environmentally nonsensical. If disposable e-cigarettes are limited to a maximum of 600 puffs, or a 2 ml fill volume, the only result is more waste.

As an alternative to larger disposable e-cigarettes, new models are now available where the disposable e-cigarette itself has a 2 ml fill volume, but also includes a 10 ml bottle of e-liquid, ultimately giving you a larger overall volume.
